Arrested After Taking a Prescribed Medication? The Criminal Case and the Drug Claim Are Not the Same File

You do not have to be a criminal to get arrested. We say that at San Diego Bail Bonds® because a lot of our calls start with a bottle that had a pharmacy label on it.

Two clocks after a prescription-related arrest

Clock one is the criminal case.
California can still charge DUI or DUID when the substance came from a pharmacy. A valid prescription is not a free pass to drive impaired. Bail gets them home so they can make court. A defense lawyer handles the charge.

Clock two is the product.
If the medication or device is the subject of a warning, a recall, or a wave of injury claims — hip implant, mesh, blood thinner, HIV meds, a recalled heartburn drug — that is a consumer / product case. It does not wait for the last criminal hearing. It also does not replace the criminal hearing.

Do not tell the booking officer “the manufacturer is at fault” and expect the cell to open. Do not tell an insurance intake person the facts of the arrest. Separate the conversations.

What to do tonight

  3. Do not flush or hide medication. Do not post the pill bottle online.
  4. Write down the drug name, dose, pharmacy, and doctor if you already know it. You will want that later.

  6. If there is a real injury from a drug or device — bleeding, implant failure, a diagnosis tied to a recalled product — that review can start after they are out. It does not have to start in the lobby of the jail.

When the product side is worth a look

Look at the product file if:

  • They were hurt by a prescription or device that has been in the news for lawsuits
  • A doctor already pulled the drug or scheduled revision surgery
  • A family member has the same implant and the same complications
  • You were told “there is a class action” and you have no idea if that is real
